In the past several years, sanctions have become an increasingly utilized method for the U.S. government to implement its foreign policy, and the rapidly shifting legal landscape creates immense challenges for compliance. Having a firm understanding of the foundational bases for sanctions and an understanding of best compliance practices is essential to avoiding violations. This course will provide an overview of U.S. primary and secondary sanctions, emerging trends, and best practices for compliance. Topics covered will include background on the regulatory framework for U.S. sanctions, recent developments and emerging trends, successfully identifying areas of risk, forming effective risk-based compliance programs, practical tips for identifying and mitigating red flags, and best practices in responding to potential violations and enforcement. Learning objectives include: (1) understanding the legal authorities and limits for sanctions jurisdiction, (2) appreciating how risks differ across different businesses and between U.S. and non-U.S. companies, (3) becoming aware of regulatory expectations and industry standards for compliance programs, and (4) gaining insight into OFAC enforcement trends and assessing how to respond to potential violations.
